Strong Girls United Event with Davidson Women's Basketball 2024

SG United Foundation (“Strong Girls United”) is a 501(c)(3) nonprofit organization with a mission to empower girls to be strong, confident, and resilient through sports, mentorship and mental health programming. Join the Davidson Women's Basketball team for a special event and PINK OUT GAME on February 3rd. Shirts will be provided along with an opportunity to stand on the court prior to the start of the game for our National Anthem. We then invite participants to stay after for a meet and greet with the team and post-game autographs!
 
NO EXPERIENCE IN BASKETBALL IS NECESSARY.

ACKNOWLEDGMENT AND ASSUMPTION OF RISKS, RELEASE AND INFORMED CONSENT SG UNITED FOUNDATION PROGRAMS AND EVENTS (“Program”) READ THIS DOCUMENT CAREFULLY. THIS RELEASE MUST BE SIGNED/AGREED TO BY ALL PARTICIPANTS IN STRONG GIRLS UNITED PROGRAMS; BY SIGNING, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS

  • In consideration of my (or my child’s or ward’s, as applicable) participation in the Program and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged:
    1. I hereby consent, for myself or on behalf of my child or ward, as applicable) to participate in the above-described Program being held by SG United Foundation (“Strong Girls United”) and/or its partner schools and organizations (“Program Partners”). I have been given the opportunity to ask questions about the Program. I have had sufficient time to consider my (or my child’s/ward’s, as applicable) participation in the Program, and my (or my child’s/ward’s, as applicable) participation is entirely voluntary.
    2. I represent to Strong Girls United that I (or my child/ward) am in good physical condition and have no known conditions, impairments or maladies that would in any way endanger me or others during the activities I (or my child/ward) may be asked to do during the Program. I understand that the Program may involve physical activity and vigorous exercise and may increase my likelihood of being exposed to or contracting COVID-19, and understand the risk associated therewith. Prior to engaging in any physical activities, Strong Girls United recommends that all participants obtain a physical examination from a doctor. I (and/or my child/ward) will follow all policies adopted by Strong Girls United or its Program Partners and any applicable laws with respect to COVID-19.
    3. I hereby irrevocably grant (for myself and/or on behalf of my child or ward, as applicable) to Strong Girls United and its Program Partners and its and their parent, subsidiaries, successors, licensees, agents, affiliates, and assignees (collectively, “Recording Parties”) the royalty-free, irrevocable and perpetual right to record, photograph, visually identify or otherwise use, reproduce, modify or edit as desired, my (and/or my child’s or ward’s, as applicable) voice, performance, appearance, likeness, photograph, name and/or biographical information (collectively, my “Appearance”) on film, video and/or audio tape, still photography and/or otherwise (collectively, the “Recording”) in connection with the Program. I also grant to the Recording Parties (for myself and/or on behalf of my child or ward, as applicable) the nonexclusive, perpetual, worldwide right, without further consideration, to use, copy, publish, reuse, or display any quote, personal statement or other testimonial and survey data (“Statement”) given by me (or my child or ward, as applicable) during or in connection with the Program or a Recording, whether given orally or in writing, in whole or in part, without restrictions, for any purpose, whether commercial or noncommercial, in any media.
    4. I agree (for myself and/or on behalf of my child or ward, as applicable) that the Recording Parties shall own all right, title and interest to the Recording, including copyrights, and shall have the worldwide, royalty-free, perpetual right to exhibit, distribute, transmit and/or otherwise exploit the Appearance and/or the Recording, edited or altered, in whole or in part, as they may see fit, in all media, now known or hereafter developed, for any purpose, whether commercial (including, without limitation, advertising, publicity, promotion or marketing) or noncommercial. The rights granted by me hereunder are granted in perpetuity and no compensation or further consideration will be payable to me (and/or my child or ward, as applicable) at any time in connection therewith. I will have no right of consultation or approval in connection with the rights granted hereunder. Nothing herein will constitute any obligation of the Recording Parties to make any use of the rights set forth herein.
    5. I hereby expressly and specifically assume the risk of injury or harm to me (or my child or ward, as applicable), including without limitation all risks associated with exposure, spread or infection of/with COVID-19, in connection with the Program and release and forever discharge Strong Girls United and its Program Partners and its and their directors, officers, employees, agents, insurers, suppliers, retailers, representatives, and the facility where the Program is to be held (the “Released Parties”) from any and all liability for injury, illness, death, or property damage resulting from my (or my child’s or ward’s, as applicable) participation in the Program, or use of the Appearance, Statement or Recording, including without limitation, any claims based on invasion of privacy, defamation, right of publicity or any other personal or property rights). I agree, for myself and my child or ward, to hold harmless, defend and indemnify the Released Parties for and from any and all claims, demands, causes of action, lawsuits, damages, injuries, expenses (including attorneys’ fees) and other liabilities of any kind arising from or in connection with the Program, or the use of my Appearance, my Statements or the Recording. Without limiting the foregoing, I acknowledge that the Released Parties are not responsible for protecting me from exposure, spread or infection of/with COVID-19 and shall not have any liability therefore or for the steps they take or do not take with respect to COVID-19.
    6. This Acknowledgment and Assumption of Risks, Release and Informed Consent (this “Release”) shall be governed by and interpreted exclusively under the laws and jurisdiction of the State of Maine. I consent, for myself and on behalf of my child or ward, to the exclusive jurisdiction of the state and federal courts of Maine for resolution of all claims, differences and disputes (if any) which arise under this Release.
    7. I hereby warrant that I have read this Release prior to its execution and am fully familiar with and understand the contents thereof. This Release shall be binding upon me and my heirs, legal representatives, and assigns. =======================================================================================================================
