Employing a Prospect or Enrolled Student Athlete
Davidson College and its Department of Athletics asks that all boosters, prior to employing or arranging for the employment of a prospect or enrolled student athlete, check first with the Davidson College Department of Athletics. The Department is permitted to make arrangements for summer employment for prospects prior to their enrollment as freshmen and to enrolled student athletes during the academic year and summer. Accurate record keeping must be maintained regarding employment. Therefore, the Athletic Department asks for your cooperation.
The “Dos and Don’ts” of Employing Prospects:
An athletics department staff member may help arrange for summer employment of a prospect with an athletics representative provided:
• The employment does not begin prior to the completion of the prospect’s senior year in high school.
• In the case of a two-year college prospect, the employment of the prospect may not begin prior to the time in which the prospect has officially withdrawn from the two-year college or has completed the requirements for graduation at the two-year college.
• Any compensation paid to the prospect by the employer must be for work actually performed and at a rate commensurate with the going rate in the locality for services of like character.
• Any employment benefits (e.g., transportation to/from job, health insurance, bonuses) provided to the prospect must be provided to all other employees performing similar services for the employer.
Provided these regulations are met, there is no limit on the amount of money a prospect can earn. If you intend to hire a prospect at your place of business, please be sure to remind the prospect that s/he should consult the Compliance Office regarding the employment arrangements.

Please DO NOT provide employment for a student athlete without first checking with the Compliance Office. Within certain guidelines, athletics department staff members are permitted to arrange employment for student athletes. All student athletes are eligible for employment at anytime during the academic year or summer provided and the Compliance Office must keep written records verifying all student athlete employment.
Any student athlete who is employed, either during the summer or during the regular academic year, must meet the following regulations:
• S/he must be compensated only for work actually performed.
• S/he may not be paid in advance. Pay can be provided only after work is completed.
• S/he may not be provided any benefit (e.g., transportation) unless the benefits are provided to for all other employees.
• S/he must be compensated at a rate commensurate with the going rate for similar services in that locale.
• S/he may not be compensated for the value or utility they may have for the employer because of the publicity, reputation, fame or personal following that they have obtained because of athletics ability.
• In regards to a sales position, a student athlete’s name, photograph, or athletics reputation may not be used to promote the employer’s business or product.
